Terms of Service / User Agreement

This User Agreement ("Agreement") is a legal agreement between you and Don't Fomo ("Developer") for the use of the web application Don't Fomo (the "App"). By using the App, you agree to be bound by the terms of this Agreement.

1. Service Description / Developer

Don't Fomo is a data viewer that displays publicly available information about Solana tokens and X/Twitter posts. The App is provided by Don't Fomo. It is not a wallet, not a broker, and not a financial service.

2. License Grant

Don't Fomo grants you a personal, non-exclusive, non-transferable, limited license to access and use the App strictly in accordance with the terms of this Agreement.

3. Restrictions on Use

You agree not to, and you will not permit others to:

License, sell, rent, lease, assign, or otherwise commercially exploit the App.
Modify, make derivative works of, disassemble, decrypt, reverse compile, or reverse engineer any part of the App.
Remove, alter, or obscure any proprietary notice (including copyright or trademark) of Don't Fomo.
Use the App to facilitate illegal activity or violate any applicable law.

4. Not Investment Advice

All data displayed in the App, including token prices, market caps, and social discussion, is provided for informational purposes only and does not constitute investment, financial, legal, or tax advice. Token markets are highly volatile. Always do your own research. The Developer makes no representation that the data is accurate, complete, or current.

5. Intellectual Property

The App, including without limitation all copyrights, patents, trademarks, trade secrets, and other intellectual property rights, are and shall remain the sole and exclusive property of Don't Fomo. Third-party data remains the property of its respective owners.

6. Privacy and Data

Your use of the App is governed by our Privacy Policy. By using the App, you consent to the collection and use of data as outlined in that policy.

7. Termination

This Agreement is effective until terminated by you or Don't Fomo. Your rights under this license will terminate automatically without notice if you fail to comply with any term(s) of this Agreement.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Don't Fomo shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use the App. The App is provided "as is" without warranties of any kind.

9. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Don't Fomo is registered, excluding its conflict of law rules.
